Switching a home loan to another lender can save money, but a lower EMI alone does not prove it. The saving has to cover every one time cost of the switch, and it has to last as long as you expect to keep the loan. This guide covers the RBI rule on prepayment charges, the costs to include, a simple payback method with worked examples, the repricing option, the transfer process, Navi Mumbai property checks, top ups and tax.

This is general information and not financial, tax or legal advice. Rates, fees and rules change, so use your own sanction letter and the new lender’s Key Facts Statement. This guide is independent and does not recommend any lender.

Prepayment charges: which RBI rules apply?

Under the Reserve Bank of India (Pre-payment Charges on Loans) Directions, 2025, dated 2 July 2025, lenders shall not levy pre-payment charges on floating rate loans granted to individuals for purposes other than business. The RBI directions say this applies irrespective of the source of funds, so a takeover by another lender counts, and to part or full prepayment with no minimum lock in.

  • Loans sanctioned or renewed on or after 1 January 2026: the 2025 Directions apply.
  • Older loans: check the earlier RBI rules applicable to your lender and loan category. Many individual floating rate home loans already had protection against prepayment penalties, and a contract clause cannot override a prohibition that applies. Ask the lender to name the regulatory basis for any charge it proposes.
  • Fixed rate and dual rate loans: the ban is for floating rate loans. For a loan with a special or dual rate, the treatment depends on whether the loan is floating rate at the time it is prepaid. Read your sanction letter.
  • Disclosure: any prepayment charge must be stated in the sanction letter, the loan agreement and the Key Facts Statement. Undisclosed charges cannot be levied.

The prohibition concerns prepayment charges. It does not mean the loan closes without accrued interest or any other lawful, disclosed amount, so ask for an itemised closure statement. RBI’s FAQ on resetting floating rates also says you can part prepay or foreclose, and that lenders must offer a switch to a fixed rate under their board policy, with switching charges disclosed.

Repricing versus balance transfer

Before switching, ask your current lender for a written repricing offer, including any conversion fee. Compare three options: staying unchanged, repricing with the existing lender and transferring to a new lender. The home loans in Navi Mumbai guide covers getting a home loan in Navi Mumbai.

Balance transfer costs to include

Cost What to ask the new lender
Processing fee The percentage or amount, the minimum, the taxes on it, and what is refundable if the application is rejected or you withdraw.
Legal and technical valuation Usually charged at actuals to the lender’s advocate and valuer. Ask for the amounts.
Mortgage and security costs Applicable mortgage or security creation, stamp duty, registration or filing costs, depending on the instrument and the requirements for the property. Ask for an itemised quotation that states the legal basis for each charge. See IGR Maharashtra.
CERSAI and documentation The actual amounts.
Old lender No prepayment penalty where the applicable rules prohibit it. Get an itemised closure statement showing principal, accrued interest and any other lawful, disclosed charges.
Top up fees Only if you take a top up. See the section below.

Use the Key Facts Statement

Item What to compare
Offered rate The sanctioned rate for you, not an advertised starting rate.
Benchmark and spread How the rate is constructed.
Reset terms When and how the rate can change. Check which changes follow the benchmark and which are contract conditions.
APR The disclosed annualised borrowing cost.
Fees Upfront, recurring and third party charges.
Repayment schedule The EMI, the tenure and the total scheduled payments.

RBI requires the Key Facts Statement to include the APR and an amortisation schedule, and charges recovered through the lender for third parties must be reflected and disclosed separately. Ask for it from each lender before you decide.

Calculate EMI savings and simple payback

  • Step 1: note the outstanding principal, the remaining months, your current rate and the offered rate.
  • Step 2: compute the EMI at each rate for the same remaining tenor. The EMI is P × r ÷ (1 − (1 + r) to the power of minus n), with r as the monthly rate and n as the months. The Home Loan EMI Calculator shows how EMI moves with rate. It is not a balance transfer calculator and does not add costs.
  • Step 3: the monthly saving is the old EMI minus the new EMI.
  • Step 4: add up all one time costs.
  • Step 5: divide the costs by the monthly saving. This gives a simple cash flow payback estimate, in months.

Compare the payback with how long you expect to keep the loan before selling, prepaying or refinancing again, as well as the remaining tenor. If you plan to close early, compare payments made plus the outstanding balance at the same future date, including switching costs, because EMI savings alone omit differences in principal repayment.

Two ways to use a lower rate

  • Lower EMI, same tenor: compare the cash flow relief and the total savings.
  • Same EMI, shorter tenor: compare the revised repayment period and the total interest. There may be no monthly EMI reduction in this case, so the payback formula does not describe it.

Worked examples: savings after costs

These are illustrations with assumed numbers and not offers. They assume an outstanding loan of ₹40 lakh and upfront costs of about ₹48,600, made up of a 0.5% processing fee plus 18% tax on it, and assumed amounts of ₹15,000 for legal and valuation and ₹10,000 for mortgage costs. The ₹10,000 is hypothetical and is not a standard Maharashtra fee. Assumptions: the principal and the remaining tenor are the same, rates stay unchanged, the costs are paid upfront and not added to the loan, there is no top up or extra prepayment, and tax effects and the time value of money are left out.

Scenario (current rate to new rate) Monthly EMI saving Simple payback Net saving after costs over the remaining tenor
15 years, 8.75% to 8.50% ₹588 82.6 months (83 payments) ₹57,305
15 years, 8.75% to 8.25% ₹1,172 41.5 months (42 payments) ₹1,62,420
15 years, 8.75% to 8.00% ₹1,752 27.7 months (28 payments) ₹2,66,735
5 years, 8.75% to 8.25% ₹964 50.4 months (51 payments) ₹9,235

A small rate gap takes much longer to pay back. In the last row the loan has only 60 months left, so the net saving after costs is about ₹9,000 and it would vanish if the new lender repriced the loan or you closed it a few months early.

Transfer process and document handover

  • Compare offers and ask each lender for its Key Facts Statement.
  • Apply to the new lender and submit your documents.
  • The new lender checks the property legally and technically, and issues a sanction.
  • Ask your current lender for a foreclosure quotation. Note how long it is valid, since interest keeps accruing until settlement.
  • The new lender pays the old lender against that quotation. Coordinate the change of payment mandates with both lenders.
  • Get written confirmation that the old account is closed, and check the list of original documents against what is released.
  • Make sure the old registered charge is released and that the new security is registered.

Keep paying your EMIs until closure is confirmed. RBI’s document release directions require lenders to release the original documents and remove registered charges within 30 days after full repayment or settlement in the cases they cover, with compensation of ₹5,000 a day for lender caused delay. That is a document release requirement and not a promise that the whole transfer finishes in 30 days. See the RBI website.

Documents

  • From the old lender: the loan statement, usually for about a year, the foreclosure or outstanding letter, the sanction letter, a list of the original property documents it holds and a consent or no objection letter.
  • From you: KYC with PAN, income proof such as salary slips, Form 16 or income tax returns, bank statements for about six months, and property papers.

Navi Mumbai property checks

A change of lender is not automatically an ownership transfer, so CIDCO resale transfer charges do not arise just because you refinance. Check these instead:

  • Whether the property is leasehold or freehold.
  • Whether the lease or allotment papers require mortgage permission, or permission for a change of lender.
  • What existing permissions the current lender already holds.
  • Which society, title and property documents the incoming lender asks for.

The incoming lender’s legal assessment protects the lender. If you want independent advice, commission it yourself. See the property lawyer guide for what to ask an advocate.

Top up loans and tax considerations

Top up

Some lenders offer an additional loan on the same property when you switch. Assess the transfer and the top up separately, then compare the combined offer. If pricing or charges depend on taking the top up, include those effects in the transfer comparison. A top up may bundle processing fees, a rate concession, additional security costs, insurance premiums, a longer tenor or fees financed into the borrowing. Its structure depends on the lender and may not be a separate account. For other borrowing against a property, see the loan against property guide.

Tax

Treatment depends on the answers to these questions:

  • Is the property self occupied or let out?
  • Which tax regime and tax year apply to you?
  • Was the replacement borrowing used to repay the eligible housing loan?
  • How was any top up used?
  • Do you have the fund trail and the interest certificates?

The Income-tax Act, 2025 deals with interest on a loan taken to repay an earlier loan within its provisions on income from house property, which you can read on the income tax website. Do not assume that every deduction continues automatically after refinancing, and ask a chartered accountant to check your own case.

Risks to weigh

  • The new lender’s reset terms can differ, so read the Key Facts Statement for how the rate can change.
  • Confirm which charges are refundable, what the lender retains, and what happens if the application is rejected or you withdraw.
  • A longer tenor lowers the EMI but raises the total interest, so compare at the same tenor.
  • Your credit score affects the rate you are offered, which may differ from the advertised rate.
  • Moving between floating and fixed rates changes your exposure to rate changes.

Frequently Asked Questions

Is there a penalty for a home loan balance transfer?

RBI’s 2025 Directions bar pre-payment charges on floating rate loans to individuals for non business purposes, for loans sanctioned or renewed from 1 January 2026. For older loans check the earlier rules for your lender and loan category, since many individual floating rate home loans already had this protection. Dual rate and fixed rate loans depend on how the loan is classified when it is prepaid.

How do I calculate whether a balance transfer is worth it?

Compute the EMI at the old and new rate for the same tenor, take the monthly saving, add up all one time costs and divide the costs by the saving for a simple payback in months. Compare it with how long you expect to keep the loan, and with net savings after costs.

What costs come with a balance transfer?

A processing fee with taxes, legal and technical valuation charges, applicable mortgage and security costs, CERSAI and documentation charges, and any top up fees. Ask for itemised amounts.

What documents are needed for a balance transfer?

From the old lender, the loan statement, a foreclosure letter, the sanction letter, a list of original documents and a consent letter. From you, KYC with PAN, income proof, bank statements and property papers.

How long does a balance transfer take?

It varies by lender. RBI’s document release rule covers the 30 days after full repayment, and it is not the time for the whole transfer. Keep paying your EMIs until closure is confirmed.

Will I keep my tax benefit after a balance transfer?

It depends on the tax regime, the use of the property and how the money is used. Ask your lender for the interest certificate and ask a chartered accountant about your case.
